SCO said it will reveal in June the Unix code has been copied into Linux, but only to select people, such as independent analysts who have signed nondisclosure agreements. It won't share that code publicly, saying the Unix code is proprietary.

Also, they say they "probably won't" sue Linus Torvalds.

Actually, there's a precedent. During one of the DeCSS trials, the prosecution presented some unsealed evidence that reproduced the DeCSS code verbatim. Defence leaped on this as dereliction of duty on the part of prosecution w.r.t. protection of the trade secret they claimed was at stake. The documents were sealed shortly thereafter.

Some people hope that, as a result of this little tiff, the AT&T vs BSD trial papers will be unsealed.
